BREQK Terms of Service

These Terms of Service ("Terms") govern your access to and use of the BREQK mobile application and related services (collectively, the "Service"), operated by BREQK ("we," "us," or "our"). Please read these Terms carefully. By creating an account or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

1. Who can use the Service

You must be at least 18 years old, or the age of majority in your country if higher, to create an account and use the Service. The Service contains mature themes relating to personal habits and is strictly for adults. By creating an account, you confirm that you are at least 18 years old and that the information you provide is accurate.

Reporting an underage user. We take the 18+ requirement seriously. If you believe someone under 18 is using the Service, or that an account belongs to a minor, please report it to us at contact@breqk.app with any relevant details. We will review every report and, where we confirm or reasonably believe an account belongs to someone under 18, we will suspend and delete that account and its associated data.

2. What BREQK is, and important disclaimers

BREQK is a self-help tool that helps you track habits you want to change, log urges, and receive AI-generated coaching and encouragement. It is intended for general wellbeing and self-improvement purposes only.

BREQK is not a medical device and does not provide medical, psychological, psychiatric, or other professional advice, diagnosis, or treatment. The AI coach is an automated system. It is not a doctor, therapist, counsellor, or licensed professional, and its responses must not be relied upon as professional advice. The coach may occasionally be inaccurate, incomplete, or unsuitable for your particular situation.

BREQK is not a crisis or emergency service. If you are in crisis, experiencing thoughts of self-harm or suicide, or in a medical emergency, do not use the Service to seek help. Instead, contact your local emergency services or a qualified crisis line immediately. We are not equipped to handle emergencies and accept no responsibility for crisis situations.

You are responsible for your own decisions and actions. Always seek the advice of a qualified professional with any questions you have about your health or wellbeing.

3. Your account

To use most features, you must create an account. You agree to:

• provide accurate information and keep it up to date;


• keep your login credentials confidential; and


• be responsible for all activity that occurs under your account.

Notify us promptly at contact@breqk.app if you believe your account has been accessed without authorisation. We may suspend or terminate accounts that violate these Terms, that we reasonably believe pose a risk to the Service or other users, or as otherwise described in these Terms.

4. Sensitive information acknowledgment

At signup, you separately acknowledge that BREQK will process sensitive information about your personal habits to provide coaching. This acknowledgment is in addition to your acceptance of these Terms and our Privacy Policy. You can withdraw from the Service at any time by deleting your account.

5. AI coaching and how your messages are used

A core function of the Service is AI coaching. To provide personalised responses, each coaching exchange is generated using your conversation history and supporting context. The conversation so far — or a compacted summary of it for longer conversations — is shared with our AI provider (Anthropic) alongside each exchange.

Supporting context includes your active habits and their details, recent urge events and their attributes, relevant statistics, notes you have written, your daily reflections, summaries of your past coaching conversations, and other information needed to personalise the coaching response. Full details of what is shared are in our Privacy Policy.

By accepting these Terms and using the AI coach, you understand and agree that your conversation history and supporting context will be processed in this way to provide the Service. This processing is necessary to deliver the coaching feature you are requesting. If you do not want your messages processed by an AI provider, do not use the AI coaching feature.

The coach also generates and stores brief summaries of conversations and may compact long conversations into shorter summaries to maintain continuity across sessions. These are stored on your account.

The coach's responses are generated automatically and may be inaccurate, incomplete, or unsuitable for your situation. You use them at your own discretion and risk.

6. Optional data collection

Separately from the AI coaching above, you may choose whether to allow us to retain de-identified data to help improve the Service, train better behavioural-health AI models, and advance research into habit-change patterns. This choice is optional, is off by default, and can be changed at any time in the app. It is described in detail in our Privacy Policy. Choosing not to enable it does not affect your ability to use the Service.

7. Subscriptions, payments, and free features

The Service offers both free features and paid subscription features ("Pro").

• Free tier: certain features are available at no cost, subject to limits we may set (for example, a limit on the number of AI coaching messages).


• Paid subscriptions: Pro features are available through a recurring subscription. Pricing and billing terms are shown in the app and are processed through the relevant app store.


• Billing and renewal: subscriptions renew automatically unless cancelled before the renewal date, in accordance with the app store's rules. You can manage or cancel your subscription through your app store account. Deleting your BREQK account does not automatically cancel your app store subscription — please cancel through your app store first.


• Refunds: refunds, where available, are handled according to the policies of the app store through which you purchased.


• Changes: we may change the features included in any tier and our pricing. Where required, we will give you notice of material changes.


• Promotional codes: we may offer promotional codes granting access to paid features. Codes are subject to any stated conditions and may be withdrawn or expire.

8. Acceptable use

You agree not to:

• use the Service for any unlawful, harmful, or abusive purpose;


• attempt to gain unauthorised access to the Service, other users' accounts, or our systems;


• interfere with, disrupt, or place an unreasonable load on the Service;


• reverse engineer, scrape, or attempt to extract source code or data except as permitted by law;


• misuse the AI coach, including attempting to manipulate it to produce harmful content or to bypass safety measures;


• upload content that is illegal, infringing, or that contains identifying information about other people without their consent; or


• use the Service to harass, harm, or impersonate others.

We may suspend or terminate your access if you violate this section. We are not required to give advance notice before suspension or termination for violations.

9. Your content

You retain ownership of the content you create in the Service, such as your habit names, notes, and messages. You grant us a licence to store, process, and use that content as necessary to operate and provide the Service — including sharing conversation history and context with our AI provider as described above, generating and storing summaries for coaching continuity, and retaining and sharing de-identified data as described in our Privacy Policy, where you have given optional consent. This licence is limited to what is necessary to run the Service and the purposes described in our Privacy Policy. We do not claim ownership of your personal content and do not use it for unrelated purposes.

10. Intellectual property

The Service, including its software, design, text, graphics, and branding, is owned by BREQK or its licensors and is protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service for your own personal, non-commercial use, subject to these Terms. You may not copy, modify, distribute, sell, or create derivative works from the Service except as expressly permitted.

11. Third-party services

The Service relies on third-party providers, including our AI provider (Anthropic), our database and authentication provider (Supabase), our server hosting provider (Vercel), our email delivery provider (Resend), and app-store and payment processors (Google Play). Your use of those services may be subject to their own terms and privacy policies. We are not responsible for third-party services, and their handling of data is governed by their own terms.

12. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that AI-generated responses will be accurate or suitable. To the maximum extent permitted by law, we disclaim all such warranties.

13. Limitation of liability

To the maximum extent permitted by law, BREQK and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of, or inability to use, the Service — including any reliance on AI-generated coaching responses — even if advised of the possibility of such damages. To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve months before the claim, or the minimum amount required by applicable law.

Nothing in these Terms limits liability that cannot be limited by law.

14. Indemnification

If your misuse of the Service or violation of these Terms causes a third party to bring a claim against us, you agree to cover our resulting costs, damages, and expenses. This is a standard protection that applies only when the claim arises from your actions, not from our provision of the Service.

15. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Service. On termination, the rights granted to you under these Terms end. Sections that by their nature should survive termination will survive, including ownership, disclaimers, limitation of liability, and indemnification.

16. Discontinuation of the Service

If we decide to discontinue the Service, we will make reasonable efforts to give you advance notice (through the app and, where possible, by email) so that you can export or request a copy of your data before the Service closes. After discontinuation, we will delete user data in accordance with our Privacy Policy.

17. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and notify you within the app and, where appropriate, by email. Your continued use of the Service after changes take effect means you accept the updated Terms. If you do not agree with the changes, you may delete your account.

18. Governing law and disputes

These Terms are governed by the laws of the Republic of Mauritius, without regard to conflict-of-laws principles. You agree that any dispute will be subject to the courts of Mauritius, unless applicable law gives you the right to bring proceedings in your country of residence.
